Síntesis de la evolución de las normas de sucesión al trono en la monarquía española
Abstract
This article is a brief study of the succession to the Crown in the different historical
stages of Spain. The great majority of historians versed in the different lines of investigation, have approached the subject to clarify the succession to The throne in
many works, offering diverse interpretations to explain their evolution. These changes, were produced in the various kingdoms prior to the unification of the crowns that result the current Monarchy, and have responded to the changing historical circumstances of the Visigothic kingdoms, the Crowns of Castile, Aragon, Navarre and the unified Spanish monarchy until our days. The changes of dynasty or political regime from the elective monarchy, through the feudal, the absolute or the liberal ones, together with the familiar circumstances of the Sovereigns, have built this complex legislative corpus, which deserves a detailed study.
A clear example of the changing circumstances, due to the political and social evolution of the Kingdom, is the current and recurring theme on the article in the current Spanish Constitution that leaves women in second place in the order of dynastic succession. In these 40 years of the 1978’s Constitution, no government has made efforts to make the necessary changes to solve it, unlike other reining royal houses.
